Terms of Service
Effective: May 2026. These terms govern mentoring engagements with Alexander Gutjahr ("I", "me"). By booking a paid mentoring session or starting a monthly mentorship, you ("you", "the mentee") agree to them.
1. What this covers
These terms apply to Agency Mentoring only, both monthly mentorship engagements and one-off paid sessions booked through a calendar link I share with you.
Fractional CTO engagements are not governed by these terms. Those are scoped per engagement under a separate agreement.
2. What's included
A monthly mentorship engagement includes three 1-to-1 working sessions per month (typically 60 minutes each) plus asynchronous review of documents you share between sessions: outreach copy, proposals, sales-call recordings, delivery plans. The exact scope is what we agree on at the start of the engagement.
A one-off Strategy Call includes a single 1-to-1 video session (typically 60 minutes) plus a short written diagnostic I send afterwards.
Mentoring is strictly 1-to-1. Group sessions and live co-working are not part of the standard offering.
3. Sessions and rescheduling
Sessions are scheduled through the calendar link I share with you. If you can't make a session, please reschedule at least 24 hours in advance. We'll find another slot in the same billing period where possible.
Sessions don't roll over to future periods. If a session can't be rescheduled within the period, it lapses.
4. Payment
One-off Strategy Calls are charged at booking time through the payment method offered on the booking page (currently Stripe via Cal.com). The session is confirmed once payment is received.
Monthly Mentorship is invoiced monthly in advance. I issue the invoice at the start of each billing period and offer multiple payment methods (typically SEPA bank transfer or card via a Stripe-hosted payment link). The first invoice is due before the first session takes place. Access continues for the period you've paid for.
Prices are stated in EUR. VAT is added where applicable; my current tax status is shown on the invoice. Late or failed payments may result in suspension of the engagement until payment is settled.
5. Refund guarantee
If after our first paid session you feel this isn't working for you, I'll refund you in full, no questions asked. Email me within 24 hours of the session ending.
After the first session, payments are non-refundable. The retainer secures my time and attention for the period regardless of how many sessions are used.
6. Cancellation
You can cancel a Monthly Mentorship engagement at any time. The current billing period remains paid and you keep access until it ends. You won't be invoiced again. There's no notice period and no cancellation fee.
I may also end an engagement at any time, for example if it's clearly not a fit, if there's a conflict of interest, or if there's a sustained breach of these terms. In that case I'll refund any unused portion of the current period on a pro-rata basis.
7. Confidentiality
Anything you share with me about your business, team, finances, or decisions is confidential. I won't disclose it to third parties or use it outside the engagement, except where required by law.
The same applies in reverse: any frameworks, templates, or written material I share with you are for your own use and shouldn't be redistributed without my written consent.
8. Recording and notes
Recording sessions by audio, video, or AI note-taking tools is only permitted with my prior written consent. I may use AI tools to generate structured notes after a session, which I'll share with you by email. If you'd prefer I don't, let me know and I'll work from handwritten notes instead.
9. No guarantees
Mentoring is advisory. I share frameworks, judgment, and direct feedback in good faith based on my own experience, but the decisions and execution remain yours. I make no guarantees about specific business outcomes (revenue, hiring success, fundraising, or otherwise). How you apply or interpret the advice is your responsibility.
10. Right of withdrawal (consumers)
If you book mentoring as a private consumer (not in the course of your trade, business, or profession) and are based in the EU, you have a statutory 14-day right of withdrawal under §355 BGB. The period begins on the day the contract is concluded (i.e. on booking).
How to exercise: send a clear statement of your decision to withdraw — by email to legal [at] alexgutjahr.com — quoting your name, the booking reference or invoice number, and the date of booking. You may use the model withdrawal form attached to §314 BGB but you don't have to.
Early start of the service: by booking a session or starting a Monthly Mentorship that begins inside the 14-day window, you expressly request that I begin providing the service before the withdrawal period ends. For a one-off Strategy Call this means your right of withdrawal lapses once that session has been fully performed (§356(4) BGB). For a Monthly Mentorship, if you withdraw before the period has been fully performed, you owe a pro-rata amount for the portion already provided up to the date I receive your withdrawal (§357(8) BGB).
The session-based refund guarantee in Section 5 applies in addition and is more generous than the statutory minimum.
11. Liability
To the extent permitted by law, my liability for any claim arising from the mentoring engagement is limited to the amount you paid me in the six months preceding the claim. This limitation does not apply to liability for intent, gross negligence, or where excluded by mandatory law.
12. Changes to these terms
I may update these terms occasionally. The version in force at the time you book or renew is the one that applies to that period. Material changes affecting an active engagement will be communicated by email in advance.
13. Governing law and jurisdiction
These terms are governed by the laws of the Federal Republic of Germany. Place of jurisdiction for any disputes is Ludwigsfelde, Germany, to the extent permitted by law.
The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. I am not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
